Terms
Terms of use
These Terms cover joinleeway.app, its waitlist and, once it opens, the Leeway app for iPhone, published by Tanel Petelot in France. You may read, link to and quote the site. The app, its interface, code, name and logo are ours: do not copy, clone or decompile them, except where the law allows. Leeway does not give medical advice. Your mandatory consumer rights are preserved.
1. Agreement
These Terms of Use (the "Terms") are an agreement between you and Tanel Petelot ("we", "us", "our"), who publishes Leeway. "Leeway" means our app and our brand. These Terms cover the website joinleeway.app, its waitlist, our content and, once released, the Leeway iPhone app with its software, features and updates (together, the "Services").
You accept these Terms when you join the waitlist or when you accept them in the app. If you only browse the website, the rules of use and the parts of these Terms that protect our rights apply to you to the extent the law allows. If you use automated tools to access the Services, these Terms apply to you from your first request. If you do not accept these Terms, do not use the Services.
Our privacy policy for the website and the waitlist, and the privacy policy of the app once it is released, explain how we handle personal data. They are not part of these Terms.
2. Who we are
Leeway is published by Tanel Petelot, in France, who is also the publication director. Email: hello@joinleeway.app. For requests about your personal data: privacy@joinleeway.app. Send any question, complaint or claim about the Services, including the app, to these addresses.
The website is hosted by Cloudflare, Inc., 101 Townsend Street, San Francisco, CA 94107, United States.
3. Who can use Leeway
The app is for adults. You must be at least 18 years old to use it.
To join the waitlist, you must be at least 13 years old, or 16 if you live in the European Union. If you are under 18, ask a parent or legal guardian first. If we learn that someone below these ages has joined the waitlist or uses the app, we will delete their data.
4. The waitlist
Joining the waitlist is free and commits you to nothing. We will send you one email when Leeway opens on iPhone. We do not promise a release date, a price, a feature or availability in your country. To leave the waitlist, write to privacy@joinleeway.app.
5. What you may do with the website
You may read, link to, share and quote the public pages of joinleeway.app, with a link to the page. Search engines and AI assistants may access, index, quote, summarize and translate them, as our robots.txt file and its content signals allow. These signals cover only content we own. They give no rights in the names, logos or screenshots of other apps shown on our pages.
This permission covers our public pages as information. It does not cover the app, its interface, its outputs, our servers and APIs, pre-release material or anything behind a sign-in. For all of these, and for any use our robots.txt file does not allow, we expressly reserve our rights to text and data mining, under article 4(3) of Directive (EU) 2019/790 and article L122-5-3 of the French Intellectual Property Code. Nothing in this section allows anyone to reproduce Leeway's interface, name or logo in another app, product or service, or to present a copy of our pages as their own.
6. Your license to use the app
Subject to these Terms, we grant you a limited, personal, non-exclusive, non-transferable and non-sublicensable license, which ends only as described in section 18, to install and use the app for your own personal, non-commercial purposes. It covers Apple devices that you own or control, as permitted by the Usage Rules in the Apple Media Services Terms and Conditions, including use by accounts linked to yours through Family Sharing.
The app is licensed, not sold. This license is subject to the conditions in section 9. Any use outside these conditions is outside the license: it is unlicensed use of our software and content, not only a breach of contract. All rights not expressly granted to you are reserved.
7. What belongs to us
Except for the names, logos and screenshots of other apps (section 15) and what you write or record (section 12), the Services and their content belong to us or our licensors. This includes the software in source and object code, the user interface, screens, layouts, visual design, look and feel, sequences and user flows, the emotion map and other visualizations, the reserve and load gauges, the texts, prompts, illustrations, videos and sounds, the structure and compilation of our content and data, and the Leeway name, logo and app icon.
We claim all rights the law gives us in these elements. Depending on the country and the element, these include copyright, design rights, database rights, trade secret protection, rights in our name and logo, and protection against unfair competition and free-riding, including concurrence déloyale and parasitisme under French law. Copying the overall look and feel of Leeway, or taking advantage of our work and investment, can be unlawful even where no single element is registered. Nothing in these Terms transfers any of these rights to you.
8. Our name and logo
Leeway, the Leeway logo and our app icon are our brand. We use them as unregistered marks. We do not claim exclusive rights in the ordinary word "leeway".
You must not use Leeway, our logo, our icon, or a similar name or sign, as or in the name of an app, product, service, domain name or social media account in the field of journaling, mood, emotions, wellbeing or AI companions, or in any other way likely to confuse people about who is behind a product or to suggest a link with us.
You may use the name Leeway, and the logo and icon unaltered, to refer to Leeway accurately, for example in an article, a review, a comparison or an AI answer, with screenshots to illustrate it, as we do for other apps. Use no more than you need, and do not suggest that we sponsor or endorse you.
Other apps called Leeway on the App Store, such as a time budget planner or an AI usage tracker, are not related to us.
9. What you may not do
- Copy, reproduce, imitate, clone, frame or mirror the Services or any part of them, including their user interface, screens, look and feel, user flows, emotion map, gauges or other visualizations, except as needed to use the Services under these Terms or as section 5 allows for the website.
- Create, or help anyone create, an app, website, product or service that copies Leeway or its interface, or that is designed to be confused with it.
- Use the app, its content or its outputs to design, build, train, fine-tune, evaluate or improve a product, service or AI model that competes with Leeway, or help anyone do so.
- Test or measure the app in a systematic or automated way, for example by submitting synthetic, recorded or scripted audio, to build or improve a competing product.
- Decompile, disassemble, reverse engineer, decrypt or otherwise try to obtain the source code, prompts, model settings, scoring rules or internal structure of the Services, except as section 10 allows.
- Modify, translate, adapt or create derivative works of the app.
- Sell, rent, lend, sublicense, distribute, publish or otherwise exploit the app or its content commercially.
- Repeatedly and systematically extract or reuse parts of our content or data, even insubstantial parts, beyond normal use of the Services.
- Access or collect content from the app, our servers or our APIs with robots, scrapers or other automated means, or access the website in a way our robots.txt file does not allow.
- Access our servers or APIs other than through the official Leeway app or website, or use another person's account, credentials or device to do so. Any other access is unauthorized, and we may block it.
- Circumvent, disable or interfere with any technical measure that controls access to the Services or protects their content, including app integrity checks, encryption, authentication and usage limits.
- Try to make the Services reveal their prompts, instructions, model settings or other non-public information, for example by prompt injection.
- Remove, alter or hide any copyright, trademark or other notice.
- Use our name, logo or icon in breach of section 8.
- Disrupt, overload or impair the Services, introduce harmful code, or use the Services in a way that is unlawful, harmful or fraudulent, including by signing someone else up to the waitlist or impersonating anyone.
You may take screenshots of your own screens and share them for personal, non-commercial purposes. This section does not limit your right to review, rate, discuss, criticize or compare Leeway, in public or in private, or the rights in section 10. If you find a security issue, report it to hello@joinleeway.app and do not exploit it.
10. Rights the law gives you
Nothing in these Terms limits rights that the law gives you and that a contract cannot remove. In the European Union, these include the rights in articles 5 and 6 of Directive 2009/24/EC and article L122-6-1 of the French Intellectual Property Code, which allow a lawful user, under strict conditions, to make a backup copy where it is needed to use the app, to observe, study or test how the app works while using it as these Terms allow, and to decompile parts of it only when this is strictly needed to make an independently created program work with it and the information is not readily available.
Before you decompile for that purpose, write to hello@joinleeway.app, and we will tell you within a reasonable time whether we can give you the information you need. You may use information obtained under these rights only for interoperability, must not share it except where that purpose requires it, and must not use it to create a program substantially similar in its expression or for any other act that infringes our rights.
11. Pre-release and beta versions
We may invite you to test versions of Leeway before they are public, for example through TestFlight. Pre-release versions, their features, screens and outputs, and anything we tell you about them, are confidential. Do not share, publish, record or show them to anyone, including in screenshots, videos or posts, until we make them public or allow you in writing. Pre-release versions may not work well and may change or stop at any time.
12. Your entries, your results and your feedback
What you record or write in the app remains yours. You allow us, and the providers that run the analysis for us, to process it only to provide the Services to you. The app's privacy policy, published before the app opens, will explain how. You are responsible for what you record, and you must not record other people without the consent the law requires.
You may keep and use the results the app gives you, such as the name of your evening, your gauges, your emotion map and your suggested steps, for personal purposes, and export them as the app allows. Our software, interface, visual design, prompts and the way results are presented remain ours. You must not use results, in bulk or by automated means, to train, fine-tune or evaluate an AI model, or to build or improve a competing product.
If you send us ideas, suggestions or feedback, you give us a free, non-exclusive, worldwide license to use, reproduce, adapt, translate and publish them, and to include them in our products and services, for the full duration of any rights in them. We have no obligation to use them, pay for them or credit you, except where the law requires it.
13. AI estimates and your health
Leeway uses artificial intelligence to estimate the emotions in your entries, from the words you say and the sound of your voice, to name your evening, to estimate your reserve and your load, to find patterns and to suggest small steps. You are using an AI system, not talking to a person. Its outputs are automated estimates. They can be wrong, incomplete or not suited to your situation. Use them as prompts for your own reflection, not as facts about you.
Leeway is a self-reflection tool for general wellness. It is not therapy and does not replace a doctor, a psychologist or any other licensed professional. It is not intended to diagnose, treat, cure, monitor or prevent any disease or mental health condition. Do not rely on it alone for decisions about your health, do not stop or delay care because of it, and do not use it in an emergency.
If you are thinking about harming yourself or are in crisis: in the US, call or text 988; in France, call 3114. In an emergency, call 911 in the US or 112 in Europe. Elsewhere, find a helpline in your country.
14. Paid features
Some features may require a paid subscription, bought through Apple's in-app purchase. Before you pay, the app shows the price, the billing period and what is included. Apple charges you, and Apple's terms govern payment, renewals, cancellation and refunds. A subscription renews automatically until you cancel it in your Apple account settings, at least 24 hours before the end of the current period. If you live in the European Union or the United Kingdom, you can withdraw from a purchase within 14 days, as described in Apple's terms. We may change the price for future periods; we will tell you in advance, and you can cancel before the new price applies.
15. Guides, comparisons and other services
The journal prompts, words for feelings, methods and comparisons on the website are general information written by the Leeway team. Leeway is a competitor of the apps it compares. Comparisons describe other apps from public sources, with the date we checked them. The names, logos, icons and screenshots of other apps belong to their owners and are shown only to identify and compare those apps, with a link to their App Store listing. The rights we claim in section 7 and our robots.txt content signals do not cover them. If something is wrong or out of date, write to hello@joinleeway.app and we will correct it.
We use some services to run Leeway, such as our host and, once the app is released, AI providers. They work for us, and we remain responsible to you for them as the law requires. Other services, such as Apple, your device, your mobile network and the websites we link to, are provided under their own terms, and we are not responsible for their content, availability or practices.
16. If you get the app from the App Store
- These Terms are between you and us only, not with Apple. We, not Apple, are solely responsible for the app and its content. These Terms do not set usage rules that conflict with the Apple Media Services Terms and Conditions; if they do, Apple's Usage Rules apply.
- We are solely responsible for maintenance and support of the app, as described in these Terms or as required by law. Apple has no obligation to provide any maintenance or support for the app.
- We are solely responsible for any warranty on the app, whether express or implied by law, to the extent it is not effectively disclaimed. If the app fails to conform to an applicable warranty, you may notify Apple, and Apple will refund the purchase price, if any. To the maximum extent permitted by law, Apple has no other warranty obligation for the app. Any other claims, losses, liabilities, damages, costs or expenses due to a failure to conform are our sole responsibility.
- We, not Apple, are responsible for addressing any claim by you or a third party relating to the app or your possession or use of it, including product liability claims, claims that the app fails to meet a legal or regulatory requirement, and claims under consumer protection, privacy or similar laws.
- If a third party claims that the app, or your possession and use of it, infringes their intellectual property rights, we, not Apple, are solely responsible for investigating, defending, settling and discharging that claim.
- You confirm that you are not located in a country subject to a US government embargo or designated by the US government as a "terrorist supporting" country, and that you are not on any US government list of prohibited or restricted parties.
- When you use the app, you must comply with any third-party agreement that applies, such as your wireless data service agreement.
- Questions, complaints and claims about the app go to us, using the contact details in section 2.
- Apple and its subsidiaries are third-party beneficiaries of these Terms. When you accept these Terms, Apple will have the right, and will be deemed to have accepted the right, to enforce them against you as a third-party beneficiary.
17. Conformity, warranties and liability
If you are a consumer in the European Union, the European Economic Area, the United Kingdom or Switzerland: you have the legal rights that apply to digital content and digital services. Leeway must conform to these Terms and to what you can reasonably expect, including from what we say about it in the App Store and on our website. If it does not, you may ask us to bring it into conformity and, if we cannot or do not, get a price reduction or end the contract, as the law provides (in France, articles L224-25-12 and following of the Consumer Code). We are responsible to you, as the law provides, for damage you suffer as a foreseeable result of our failure to perform these Terms, except where the failure is caused by you, by the unforeseeable and unavoidable act of a third party or by force majeure. These Terms do not limit these rights.
Everyone else: to the extent the law allows, the Services are provided "as is" and "as available", and we disclaim all warranties, express or implied, including implied warranties of merchantability, fitness for a particular purpose, title, accuracy and non-infringement. We do not promise that the Services will be uninterrupted, secure or free of errors. To the extent the law allows, we are not liable for indirect, incidental, special, consequential or punitive damages, or for loss of profits, revenue, goodwill or data, and our total liability for all claims relating to the Services is limited to the greater of the amount you paid for the Services in the 12 months before the claim and 50 US dollars. Some states and countries do not allow these limits, so they may not apply to you.
For everyone: nothing in these Terms limits liability for death or personal injury caused by negligence, for fraud, or for gross negligence or willful misconduct.
18. Changes, suspension and termination
We may change the Services for valid reasons: to fix errors, keep them secure, comply with the law, adapt to changes made by Apple or our providers, or improve or add features. These changes cost you nothing extra. If a change reduces your use of a paid feature in a way that is more than minor, we will tell you clearly at least 30 days in advance, and you may end your subscription free of charge within 30 days after the change, with a refund of the part paid for the period after it.
We may suspend or end your access if you seriously breach these Terms, if the law requires it, or if your use puts the Services, other users or third parties at risk. We will tell you why and, where possible, warn you first and give you a chance to fix the problem. In urgent cases, we may act first and tell you right after.
We may stop the Services altogether. If we do, we will tell you at least 60 days in advance, stop any further charges, refund the unused part of any period you have paid for, and let you export your entries before they are deleted. You may stop using the Services and delete the app at any time.
The sections on what belongs to us, our name and logo, what you may not do, your entries and feedback, AI and health, the App Store, liability, indemnity, protecting our rights, law and disputes, and general terms continue to apply after your access ends.
19. Indemnity
If you live in the United States, or use the Services other than as a consumer, you agree to cover our reasonable losses and legal fees arising from a third-party claim caused by your breach of these Terms or your unlawful use of the Services. We will tell you about the claim promptly and let you take part in the defense. If you are a consumer elsewhere, you are responsible for damage you cause by breaching these Terms, as the law provides.
20. Protecting our rights
Any use of the Services that these Terms do not allow, including copying the app, its interface or its brand, may infringe our rights or amount to unfair competition, and we may take legal action. A breach of sections 7 to 9 could cause us harm that money alone cannot repair. In that case, we may ask any competent court for urgent measures to stop or prevent the breach, including an injunction, a seizure or an order to preserve evidence, in addition to any other remedy.
If you believe that content in our Services infringes your rights, write to hello@joinleeway.app with your name and contact details, the work or right concerned, where the content appears, why you believe it infringes your rights, and a statement that your notice is accurate and made in good faith. We review every notice and remove or correct content where it is justified.
21. Law and disputes
If you have a disagreement with us, you may first write to hello@joinleeway.app, and we will try to settle it with you. This step is optional and does not stop you from going to a mediator or a court.
Consumers outside the United States: these Terms are governed by French law, and you keep the protection of the mandatory rules of the country where you live. You may bring proceedings before the courts of the place where you live or before the French courts. We may bring proceedings against you only before the courts of the place where you live.
Consumers in the United States: these Terms are governed by the laws of the state where you live and by applicable US federal law.
Everyone else: if you use the Services other than as a consumer, these Terms are governed by French law, and the courts of Paris, France, have exclusive jurisdiction.
22. General
These Terms are the agreement between you and us about the Services. If you are a consumer, this does not exclude what we told you before you accepted them, or what we say about Leeway in the App Store or on our website, to the extent the law gives it effect. If a provision is found invalid, the rest remains in force. Our failure to enforce a provision is not a waiver. You may not transfer your rights under these Terms. We may transfer ours, for example to a company that takes over Leeway, without reducing your rights.
These Terms are written in English. If we provide a translation, the English version prevails, except where the law of the place where you live requires otherwise.
23. Changes to these Terms
We may update these Terms to reflect changes in the law, in the Services, in Apple's rules or in how we run Leeway. We will not use an update to raise the price of a period you have already paid for, or to remove the main features of a subscription during that period. If an update affects your rights, we will say so on this page and, once it is released, in the app, at least 30 days before it applies; if you do not agree, you may stop using the Services and cancel your subscription before it applies, with a refund of the unused part of any period you have paid for. Minor changes that do not affect your rights apply when we publish them. The date at the top shows the latest version.
